Exactly, so I reckon I’ll be with them for a good while yet, jeez, I hope they don’t read this post Ozziedog,,,,,,,,,,,,it’ll be double next year
But you have agreed to stump up for your manager's damaged car which will, I guarantee you, be three times as much as your guestimate....!
And yet no pictures of the damage... I think it’s safe to say.... no one was trying to steal your zafria
it’s a very very nice Zafira I’ll have you know. Just a little scrape on the drivers door but perfecto apart from that. Ozziedog,,,,,,,,,,cheeky cheeeeeeeky upstarts!
But in reality they haven’t insured a car that you can’t claim on . They have incepted a policy of insurance that was based on a unilateral mistake. I have put the legal position in an earlier post as to what generally happens to a contract in those circumstances. I’ve wracked mine as well.
Not a question of blame. Oz made an honest “ mistake” and accepts it. Yes, no problem in asking the question, but I refer back to my reply at 7.11. Matters have now moved on, factually the Insurers have stated that he wasn’t insured pre incident, they have effectively nullified an existing policy based on receiving incorrect information, they may well void the policy post incident. I hope not and that they will negotiate with Oz a way round it
Not necessarily, they may be, quite rightly verifying what you have told them, in which case there is hope that the policy won’t be cancelled , they have ,in my view, been reasonable in keeping you on cover, post incident pending verification. Stay polite and cool with them Oz
@Ozziedog I would not be impressed with the situation where they say you weren't covered but you ain't having the money back you spent for them not to cover you. It's either one or the other. Sounds to me like they're trying to frighten you into letting them keep the money for no cover. Stay calm obviously but once it's sorted with the plod I'd be after that "money for nothing". Post #67 was the one about you not being covered for the camper for the past 18 months either as it depends on also having a proper insurance on another ve-hickle.
Don’t think plod is involved, may be wrong. Also I may have missed the point that they have stated no return of premium. Agree..stay calm
post #70 "I’m not insured previously to that and I’m not getting any money back and the guy sounded rather ominous and ready to send the peelers around to sort me out or so it sounded."
Not good on this posting and pasting malarkey but opening post said police regarded it as a civil matter. What you have quoted is a perception………..by Oz ….. “ or so it sounded” . This is most unlikely to be a police matter. Likely to be private land, Car parked on private land. A genuine error by Oz
If the insurers terminate the policy, will @Ozziedog have to declare a it on future policies for say life or house insurance or just for motor insurance?
This post has reminded me of my old Austin Champ. I purchased it and insured it as XSL 857 (the number on the V5), a year or so later I was getting ready for a show and had to take my insurance certificate when I happened to notice the number plates were wrong as they said SXL 857. They'd probably been wrong for years, I didn't have time to get new ones for the show so I had to quickly paint new numbers on. It's easily done!
Just a thought . . Does your boss have "uninsured driver" cover where she can claim when hit by an uninsured driver without losing her ncd?
Thats why the sensible ones sell you another additional policy component that pays for a professional to deal with your claim.. On a couple of occasions I have used one of these to enquire about making a claim without having to make a claim.. Check if your house policy has third party legal advice too..
As I’m in uncharted waters and seeking advice from every corner of the globe (again) I think the bigger picture is to be able to have a decent level of insurance for the future and swallow a bit of a bitter pill right now. They have absolutely no intention of giving me any money back but they did change the details (for a fee ) gulp. I will at the very least be totally insured forthwith including my van which I hadn’t even considered. I won’t delve too deeply into that but thanks for the heads up. I’ve had my pants dropped and my bums had a proper good spanking. I’ll be paying for the boss’s Insignia damages and hopefully that should be the end of the matter. Im not too pleased with their avant- guard attitude when I’m being held to ransom at the risk of being on the naughty boys list for the insurance gang and insisting on a refund seems to put me on that list. There is the ombudsman but I’m thinking they’ll have another dagger in my back if I choose that route and I’m not happy about the whole situation but if I pay then it ends hopefully. Ozziedog,,,,,,,,,hopefully, at the very very least, someone here will gain from this debacle
Would a chat with Citizens Advice help you at all or maybe one of those free one hour consultations with a solicitor to gauge some advice? Hope you get sorted out okay Oz
Wow Ozzie what a story. Hats off mate for your attitude towards it and let's hope it doesn't get any more complicated and it gets filed under 'stories for around the fire at TE'
